REGULATIONS FOR USING TRADERCOM INVESTMENTS ELECTRONIC SERVICE (TERMS & CONDITIONS)

These regulations (hereinafter referred to as the “Regulations”) define (1) the rules for using the TRADERCOM INVESTMENTS electronic service at www.tradercom.pl (hereinafter referred to as the “Service”) and (2) the disclaimer.

I SUPPLIER

The Supplier of the contents provided in the Service at www.tradercom.pl (hereinafter referred to as the “Service”) and the Service administrator is Piotr Grela conducting business under the name of “Piotr Grela Tradercom Investments” (hereinafter referred to as “TRADERCOM INVESTMENTS” or the “Supplier”), entered under the number 73270 in the Register of Businesses kept by the City Hall in Gdynia.

II CONTENTS

The contents provided in the Service are related to the analysis of futures markets as well as the author’s own short-term investments.  The contents are not advice or recommendations for the Service users (hereinafter: the “User” or “Users”) – they represent exclusively the Supplier’s personal opinions.

III ACCESS

Access to the contents provided in the Service and the User status is obtained by registration on the Web site at http://dev.tradercom.pl and payment of the access fee. Access fees are shown in the price list at the same address.

IV PERSONAL DATA AND PRIVACY

As the administrator of the personal data gathered and processed in the Service, TRADERCOM INVESTMENTS shall take care of the security of the data provided by users at registration in the Service and in using the Service, protecting it in particular against access of unauthorized persons. TRADERCOM INVESTMENTS warrants that all the Users may exercise their rights under the Personal Data Protection Act of 29 August 1997, to include in particular the right to inspect their own personal data, the right to demand updating and deletion of data and the right to file objections in cases defined under the Act. The personal database kept by TRADERCOM INVESTMENTS has been notified to the Inspector General for Personal Data Protection for the purpose of registration of the personal data file. Information included in the Service system logs may contain various data, e.g. the IP address. TRADERCOM INVESTMENTS shall use the data exclusively for technical purposes. Access to the above data may be provided to the authorized entities pursuant to the applicable  laws in the event of breach of rights of TRADERCOM INVESTMENTS, a hacking attempt or any other act to the detriment of TRADERCOM INVESTMENTS.  Some areas and functionalities of the Service may uses cookies, i.e. text files saved on the User’s computer identifying the User in the manner required to allow certain operations. Among other things cookie files are used to store data required to log in the User. Cookies can be used provided that they are accepted by the browser and they are not deleted from the disk.

V COMMERCIAL INFORMATION

TRADERCOM INVESTMENTS reserves the right to send messages to the Users. The messages shall include information relating directly to the Service operation (e.g. changes in functionality) or non-commercial letters (e.g. news, system messages). All advertising contents related to the commercial activities of TRADERCOM INVESTMENTS and its clients may be sent to the Users exclusively with their consent, pursuant to Art. 10 of the Act on Providing Services by Electronic Means of 18 July 2002.

VI COPYRIGHT

TRADERCOM INVESTMENTS is the owner of copyright in the contents that are subject to protection under the Copyright and Neighbouring Rights Act of 2 February  1994 or is authorized to use the contents provided in the Service on the basis of the relevant authorization or licence. Consent of TRADERCOM INVESTMENTS in writing shall be required for third parties to multiply (copy) and disseminate the contents provided by a third party in the Service.

VII TRADEMARK

TRADERCOM INVESTMENTS is the sole owner of the rights to the TRADERCOM INVESTMENTS trademark within the meaning of the Industrial Property Act of 30 June 2000. Consent of TRADERCOM INVESTMENTS in writing shall be required to use the TRADERCOM INVESTMENTS trademark and other trademarks used in the Service.

VIII DISCLAIMER

TRADERCOM INVESTMENTS shall not be liable for any disruption to the Service operation caused by force majeure, equipment breakdown or unauthorized interference of Users, even if the Users’ data were lost as a result.

TRADERCOM INVESTMENTS shall not be liable for temporary inability to use the Service functions by the Users resulting from changes to and development of the system and technical solutions of the Service.

TRADERCOM INVESTMENTS shall not be liable for the Users’ actions, including investment decisions made by the Users on the basis of the contents published by TRADERCOM INVESTMENTS in the Service.

IX RIGHT OF THE SUPPLIER

If it is possible for the User to publish his/her contents in the Service, including the Internet forum, the User may be prevented the access to such functions by the Supplier, should the Supplier consider that there is a risk that the contents published by the User in the Service is in breach of the law.

X COOKIES POLICY

XI REFERENCE

In mattes not governed by these Regulations the applicable laws shall apply.
